2. Scope of Personal Data Processed, Purpose and Legal Basis of the Processing and Duration of the Data Retention

The Controller processes the personal data detailed below in order to contact you, provide you with services and comply with legal obligations. All data processing operations are carried out in accordance with the applicable legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, hereinafter "GDPR").

    • Purpose of processing: Based on the information you provide, to process your enquiry, provide you with further information about the property, send you personalised offers, answer your questions about the property and ensure direct contact with the Data Controller. The information provided in the message box will help us to better assess your needs.

    • Legal basis for processing: Your voluntary and informed consent (Article 6(1)(a) GDPR). The provision of data is necessary for contacting you.

    • Duration of data storage: Until 6 (six) months after the end of your request. Where the contact leads to a business relationship, for the entire duration of the business relationship or for 5 (five) years from the date of performance of the contract, unless a longer retention period is required by law (e.g. 8 years for accounting records).

  • Subscribe to the newsletter

    • Scope of data processed: E-mail address

    • Purpose of processing: Sending newsletters about what's new on the Website, recent property listings, market analyses, exclusive properties and other real estate market information and promotions deemed relevant by the Data Controller.

    • Legal basis for processing: Your voluntary and informed consent (Article 6(1)(a) GDPR).

    • Duration of data storage: Until you unsubscribe from the newsletter or withdraw your consent to the processing. All newsletters include the option to unsubscribe.

    • Scope of data processed: IP address, browser type, operating system, language settings, resolution, pages visited, duration of visit, referring page, clicks, time spent on website.

    • Purpose of processing: Optimising the functioning of the Website, improving the user experience, generating statistics on visitor habits, measuring the performance of the Website, troubleshooting and providing analysis for marketing purposes.

    • Legal basis for processing: Legitimate interest of the Data Controller (Article 6(1)(f) GDPR) - the effective operation and development of the Website and the promotion of our services. The Data Controller shall comply with the following principles when processing personal data:

Your personal data may only be disclosed to the Data Controller and its carefully selected data processors. The processors will process your data strictly in accordance with the instructions of the Controller, for the purposes for which they are processing it, and will themselves apply appropriate data security measures.

5. Your Data Protection Rights

You have the following rights under the GDPR in relation to the processing of your personal data:

  • Right to erasure ("right to be forgotten") (Article 17 GDPR): You have the right to have your personal data erased by the Data Controller without undue delay at your request if one of the following grounds applies:

    • the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;

    • You withdraw your consent on which the processing is based and there is no other legal basis for the processing;

    • You object to the processing (Article 21(1) GDPR) and there are no overriding legitimate grounds for the processing, or you object to processing for direct marketing purposes (Article 21(2) GDPR);

    • the personal data have been unlawfully processed;

    • the personal data must be erased in order to comply with a legal obligation under Union or Member State law applicable to the Data Controller.

    • It is important to note that in certain cases (e.g. to comply with a legal obligation, to bring, enforce or defend a legal claim), the Data Controller may refuse to erase the data.

  • Right to restriction of processing (Article 18 GDPR): You have the right to obtain, at your request, restriction of processing by the Controller if one of the following conditions is met:

    • You contest the accuracy of the personal data, in which case the restriction applies for as long as the Controller verifies the accuracy of the personal data;

    • the processing is unlawful and you object to the deletion of the data and instead request the restriction of their use;

    • the Controller no longer needs the personal data for the purposes of processing, but you require them for the establishment, exercise or defence of legal claims; or

    • You have objected to the processing (Article 21(1) GDPR); in this case, the restriction applies for the period until it is established whether the legitimate grounds of the Controller prevail over your legitimate grounds.

  • Right to data portability (Article 20 GDPR): You have the right to receive personal data concerning you which you have provided to the Controller in a structured, commonly used, machine-readable format and the right to transmit such data to another controller without hindrance from the Controller, if the processing is based on consent and is automated.

  • Right to object (Article 21 GDPR): You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data based on Article 6(1)(e) (performance of a task carried out in the public interest) or (f) (legitimate interest) of the GDPR, including profiling based on those provisions. In such a case, the Controller may no longer process the personal data unless you demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims. Where personal data are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such purposes, including profiling, where it is related to direct marketing.

  • Right to withdraw consent: If the processing is based on your consent, you can withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent that was carried out prior to the withdrawal.
